The Canada Labour Code General Holiday Formula Explained

Under Part III, Division V of the Canada Labour Code (Section 196), general holiday pay depends on the employee's pay structure:

  • Hourly & Salaried Employees: At least one-twentieth (1/20) of the regular wages earned by the employee in the 4 weeks immediately preceding the week of the general holiday (excluding overtime).
  • Commission & Partly Commission Employees: At least one-sixtieth (1/60) of the wages earned in the 12-week period immediately preceding the week of the general holiday (excluding overtime).
Hourly: General Holiday Pay = 1/20 × Wages (excl. OT) in 4 Weeks Prior
Commission: General Holiday Pay = 1/60 × Wages (excl. OT) in 12 Weeks Prior
